Dental Whitening: Safety and European Regulation

Dental whitening in Europe is regulated by a precise legal framework, Directive 2011/84/EU, which amended the previous Cosmetics Directive (76/768/EEC, later merged into Regulation (EC) No. 1223/2009) implementing the conclusions of the Scientific Committee on Consumer Safety. The stated goal of the regulation is to protect consumers from uncontrolled use of whitening products, firmly placing professional whitening practice in the hands of the dentist and dental hygienist.

The regulation distinguishes three categories of products based on the concentration of hydrogen peroxide present or released. Over-the-counter products, for independent consumer use without need for prescription or supervision, may contain a maximum concentration of 0.1% — a level low enough to be considered entirely harmless, but also to produce rather limited aesthetic results. Cosmetic products, covering concentrations between 0.1% and 6%, may only be used by dentists or dental hygienists, either in-office or through supervised at-home protocols with preformed or custom trays. Medical products, finally, contain concentrations above 6% — in clinical practice typically between 25% and 40% — and are reserved exclusively for in-office treatment by qualified professionals, given the high percentage of active ingredient and the precautions needed for its safe use.

A second regulatory pillar concerns minimum age: the directive establishes that use of whitening products with concentrations above 0.1% is prohibited for patients under 18 years old, unless the treatment is specifically intended to treat or prevent a pathology — purely cosmetic whitening doesn't fall under this exception. Similarly, the Medical Devices Directive (93/42/EEC) excludes use of these products in pregnant women.
